New York Unpaid Wages & Fair Labor Standards Lawyers

If you have been misclassified by your employer, or have not been paid wages you were owed or for work actually performed, you have recourse.

The Fair Labor Standards Act (FLSA) protects employees who have not been paid overtime or other wages, have opposed illegal wage and labor practices, and who stand up for others.

The FLSA also includes the Equal Pay Act which requires women to earn equal pay for equal work. Successful Equal Pay plaintiffs may recover liquidated damages – meaning an additional amount equal to their actual lost wages.

Individuals who oppose or complain about violations of the FLSA, or who stand up for others, are protected from retaliation. Recent cases from the United States Supreme Court and the Second Circuit (the federal appeals court that encompasses New York) have made it easier for plaintiffs to assert successful FLSA retaliation cases.
